According to one of the experts, the courts did not take into account the established practice. According to the second, despite the fact that the definition is actually based on quite obvious norms of the current legislation, it contains important legal positions regarding the need to protect the housing rights of citizens.
On January 19, the Supreme Court issued Determination No. 19-КАД21-17-К5, in which it explained that the land plot could not be the subject of an auction, given the lack of a judicial act on the withdrawal of an unfinished construction object on it.
Since 2014 Elvira Yambaeva has been the owner of an unfinished construction project with 18% readiness. The land plot on which the object is located was previously provided to the former owner of the object under a lease agreement for a period of 10 years. Based on the agreement on the replacement of persons in the contract, she entered into a lease relationship.
When the original lease agreement between her and the Essentuki Municipal Property Committee expired, they entered into a new agreement under which the land was leased for completion of construction for the period from April 11, 2014 to April 10, 2017. Upon the expiration of the lease agreement Elvira Yambaeva continued to use the land on the same terms. On December 24, 2018, the Municipal Property Committee sent a notice of unilateral termination of the lease agreement due to its expiration.
In February 2019, Elvira Yambaeva applied to the administration for a land plot to be leased to her. Refusing, the administration indicated that the land plot was provided for three years to complete the construction once, while documents confirming the presence of a residential building owned by it on the property right were not presented, as well as documents confirming the right to acquire a land plot without bidding.
Then the woman appealed to the Essentuki City Court, noting in the lawsuit that her difficult financial situation and the presence of two minor children did not allow her to complete the construction on time, but the site was developed, the degree of readiness of the object of construction in progress of a residential building was increased from 18% to 41 %. In addition, the administration did not file a demand to confiscate the unfinished construction object from it within six months from the date of expiration of the lease agreement. Nevertheless, the court found the refusal lawful, pointing out that the possibility of obtaining a land plot without holding an auction once to complete the construction had already been used earlier. Since the appeal and cassation left the decision of the first instance unchanged, Elvira Yambaeva appealed to the Supreme Court.
Having studied the case materials, the Supreme Court noted that the current land legislation provides for the right of the owner of an object of construction in progress, lawfully erected during the period of the lease agreement and on the basis of proper permits on the land plot provided for its construction, to conclusion (prolongation) after March 1, 2015 .one-time lease agreement to complete construction without bidding for three years. At the same time, the condition must be observed that such a land plot after the specified date was not provided for the completion of the construction of this object to any of the previous owners of this object.
The Supreme Court pointed out: The Land Code establishes that a land plot in state or municipal ownership on which a building, structure, construction in progress, owned by citizens or legal entities is located (subclause 8, clause 8, article 39. 11) cannot be the subject of an auction. By virtue of paragraph 4 of Art. 39.16 of the Land Code, the authorized body makes a decision to refuse to provide a land plot that is in state or municipal ownership, without holding a tender, if a building, structure, object of construction in progress, owned by citizens or legal entities, is located on the land plot indicated in the application for the provision of the land plot. By virtue of paragraph 1 of Art. 271 of the Civil Code, the owner of a building, structure or other real estate located on a land plot owned by another person has the right to use the land plot provided by such a person for this property. These legal provisions, the Court emphasized, are aimed at implementing the fundamental principle of the unity of the fate of land plots and objects firmly associated with them, according to which all objects firmly associated with land plots follow the fate of land plots, except for cases established by laws (subparagraph 5, paragraph 1, article .
1 ZK).
In addition, the Supreme Court noted that from the content of sub. 2 p. 5 art. 39.6 of the LC it follows that upon termination of the lease agreement, the public owner of the land cannot dispose of the object of construction in progress, created during the period of the lease agreement and on the basis of proper permits, without a court decision. The law allows the possibility of withdrawing such an object only under certain circumstances (when the owner of an object under construction abuses his right, in particular when the land plot is not used for construction purposes for a long time without good reason), which are subject to establishment by the court as part of the consideration of the claims of the public owner of the site, declared under Art. 239.1 Civil Code. This rule, the Court noted, corresponds to the restrictions provided for by Art. 10 of the Civil Code, which establishes the limits for the exercise of civil rights, and is a guarantee of protecting the rights and legitimate interests of bona fide persons who took appropriate measures, but allowed a violation of the construction deadlines through no fault of their own.
“In the absence of such a judicial act, the owner of an object of construction in progress has the right to demand the conclusion of a lease agreement with him to complete the construction,” the ruling states. The Supreme Court noted that these rights of the public owner of the land plot and the owner of the object of construction in progress located on it are interconnected, which follows from the analysis of paragraph 5 of Art. 1 and sub. 2 p. 5 art. 39.6 ZK.
The Supreme Court pointed out that, taking into account the location of an unfinished construction object owned by Elvira Yambayeva on the land plot, and the absence of a judicial act on the withdrawal of this object, this plot cannot be provided to other persons, cannot be the subject of an auction. The court noted that since the public owner of the land plot did not exercise the right to apply to the court with a claim for the withdrawal of the object of construction in progress by selling it at public auction within six months from the date of expiration of the lease agreement, as established by subpara. 2 p. 5 art. 39.6 LC, Yambayeva has the right to a one-time extension of the lease agreement without bidding to complete the construction of the facility.
The Supreme Court also pointed out that the administrative plaintiff referred to the presence of good reasons for which she did not have time to complete the construction of a residential building. She indicated that the object was purchased to improve the living conditions of her family, which included two minor children, and in the absence of a lease agreement, she was deprived of the opportunity to complete the construction of the house.
“Taking into account the circumstances established in the case, the refusal of the administration to conclude a lease agreement for a land plot to complete construction for a period of three years prevents the family of the administrative plaintiff from improving their living conditions, violates the constitutional principles of legal certainty, fairness, maintaining citizens’ confidence in the actions of the state, as well as the balance of the constitutional protected values, public and private interests,” summed up the Supreme Court. The court recognized the refusal of the municipal property committee of Yessentuki as illegal.
In a commentary to AG, Valentina Yashchenko, a lawyer for the Moscow Region Administrative Office, noted that the courts did not take into account the established practice that gives the owner of an unfinished construction object, legally erected during the period of the lease agreement and on the basis of proper permits on the land plot provided for its construction, the right to conclusion (prolongation) after March 1, 2015 of a one-time lease agreement for completion of construction without bidding for three years, provided that such a land plot after the specified date was not provided for completion of construction by any of the previous owners of this object.

What to do if you are refused?
A number of legislative norms define the procedure for appealing against cases when the local administration does not give a building permit. The decision made by the authorized instance can be challenged in the pre-trial procedure or by applying to the judicial authority.
The refusal can be safely considered illegal if the applicant provided all the papers required by law, and the representatives of the administration did not give reasons for their negative decision. In any case other than the six listed above, an unsatisfactory decision by the local administration can be considered illegal and challenged.
In the pre-trial resolution of the problem, the applicant sends an official letter to the local administration demanding that the actions of a specific authorized employee be recognized as contrary to the law. To recognize the actions of the management as contrary to legislative norms, one should contact the representative office of the local administration.
The leadership of the district administration considers applications for contesting refusals to issue building permits within five working days. In addition to the application itself, the authorized person carefully examines the grounds on which the local administration argued the negative decision.
The application review process can have two outcomes:
- a refusal and a detailed description of the motivation for making such a decision;
- taking into account the requirements of the applicant with the subsequent cancellation of the decision of the local administration and the imputation of the obligation to the authorized person to issue a building permit within a certain time frame.
If a citizen has doubts about the adequacy of the results of consideration of the application, then the actions of the management of the instance can be appealed through the higher management. In this case. Verification of the information contained in the complaint will be collegial. After consideration of the claim by a special board, the applicant will receive a detailed written response.
In practice, it becomes obvious that the mechanisms of pre-trial resolution of the problem are more accessible to the population. If the results of such events do not satisfy the applicant, he has the opportunity to apply to the court in search of justice.

Changes in building permit refusals in 2018
2018 did not introduce significant changes to the practice of issuing refusals to grant a construction permit. The legal basis for granting permits for the construction of residential facilities is given in Article 51 of the Civil Code of the Russian Federation. Certain changes will come into effect from 2021

It is not allowed to issue construction permits if the Unified State Register of Real Estate does not contain information about the boundaries of the territorial zones in which land plots are located on which construction is planned, reconstruction of capital construction objects (with the exception of construction, reconstruction of objects of federal significance, objects of regional significance, objects of local importance of the municipal district and capital construction projects on land plots to which urban planning regulations do not apply or for which urban planning regulations are not established).”;
This year, the so-called “dacha amnesty” ceases to operate. Permission is not required for objects built before the specified date, provided that the applicant has time to submit documents for state registration. In such cases, a copy of the cadastral passport will act as the only paper confirming the creation of a residential building and containing its detailed description. If the documents for registration are sent later than March 1, 2018, then the lack of a building permit will become a serious obstacle to the successful completion of the procedure. The permit itself will turn into a necessary document, which is no longer possible to refuse to receive.
In other aspects, the procedure for issuing permits for the construction of capital residential buildings will be almost identical to previous years.
