Experts of the Federal Cadastral Chamber of Rosreestr told in what cases it is possible to build a house in a forest clearing.

What is the first thing a person who wants to build a house in the forest needs to do?

Find out what category of land the selected plot belongs to and to whom it belongs. After all, building a house for permanent residence is far from possible everywhere. The land plot must be of the category “land of a settlement”, and its type of permitted use – for individual housing construction, personal subsidiary farming (household plot) or gardening.

Experts recommend obtaining data from two registers at once – the State Forest Register (SLR) and the Unified State Real Estate Register (EGRN).

Why isn’t there enough data from just one registry?

Let’s start with the fact that the GLR contains information about forests, their use, protection, protection, reproduction, forest areas and forest parks. The objects contained in this register are not real estate objects and cannot be the subject of transactions.

Registration of the right in the USRN is the only proof of ownership of a particular property.

Thus, the SLR and USRN contain different information about the same site, so it is better to check both.

What are the options for the development of events?

1. Both registers indicate that the selected land plot is part of the forest fund. This means that the construction of a residential building is prohibited there.
2. According to the forest register, the land belongs to the forest fund, and according to the USRN – to the lands of a settlement or a garden partnership. In this case, according to the “forest amnesty”, the USRN data are considered a priority. But this rule applies only if the rights to the land plot arose before January 1, 2016.
3. The land plot belongs to the lands of settlements. Here, with the construction of problems will not arise. You can buy or rent land and build a house on it.
4. The plot is included in the garden partnership. It can be obtained by becoming a member of the partnership, since such plots are distributed only among members of the SNT.
