Unauthorized change of the facade of the MKD

It is not uncommon for the owners of non-residential premises on the ground floor of an apartment building to change the appearance of the facade during the improvement of their premises.

The facade of an apartment building belongs to the common property of the owners of the premises in such a building. This is provided for in paragraph 3 of part 1 of Art. 36 of the Housing Code of the Russian Federation and clause 2 of the Rules for the maintenance of common property in an apartment building, approved by Decree of the Government of the Russian Federation of August 13, 2006 No. 491 (hereinafter – Rules 491). Any re-equipment of the facade and the installation of any structures requires approval at a general meeting of owners.

According to paragraphs. “d” clause 10 of Rules 491, the common property must be maintained in accordance with the requirements of the legislation of the Russian Federation (including on the sanitary and epidemiological welfare of the population, technical regulation, consumer protection) in a condition that ensures the observance of the rights and legitimate interests of the owners of the premises, as well as other persons.

In accordance with paragraph 41 of Rules 491, , the owners of the premises are responsible for the proper maintenance of the common property in accordance with the legislation of the Russian Federation.

By virtue of paragraph 2 of Art. 209 of the Civil Code of the Russian Federation , the owner has the right, at his own discretion, to take any actions in relation to the property belonging to him that do not contradict the law and other legal acts and do not violate the rights and legally protected interests of other persons.

According to parts 1, 4 of Art. 30 of the Housing Code of the Russian Federation, the owner of the residential premises shall exercise the rights of possession, use and disposal of the residential premises owned by him in accordance with its purpose and the limits of its use, which are established by this Code. The owner of the residential premises is obliged to maintain the premises in proper condition, preventing mismanagement of them, to observe the rights and legitimate interests of neighbors, the rules for the use of residential premises, as well as the rules for maintaining the common property of the owners of premises in an apartment building.

As follows from the established judicial practice, the requirements and standards for the maintenance and service of the housing stock are determined, including by the Rules and norms for the technical operation of the housing stock, approved by the Decree of the State Committee of the Russian Federation for Construction and Housing and Communal Complex dated 09/27/2003 N 170 (hereinafter referred to as Gosstroy Decree No. 170 ), are mandatory for both owners of premises and managing organizations (Decision of the Arbitration Court of the Moscow Region of July 12, 2016 in case No. А41-25204/2016, Decision of the Arbitration Court of the Moscow Region of December 28, 2015 in case No. А23-6425/2015, etc.)

According to clause 1.7.2.
Decrees of Gosstroy No. 170
Re-equipment and re-planning of residential buildings and apartments (rooms), leading to a violation of the strength or destruction of the supporting structures of the building, a disruption in the operation of engineering systems and (or) equipment installed on it, deterioration in the safety and appearance of facades, violation of fire-fighting devices, are not allowed.

Coordination of a change in the facade of a non-residential building in Moscow from August 1, 2022

On August 1, 2022, new requirements for changing the appearance of non-residential buildings come into force. They are spelled out in Moscow Decree No. 94 “On changing the external architectural design of non-residential buildings, structures, structures in the city of Moscow.”

Now the procedure for agreeing to change the architectural appearance of buildings is approximately the same as agreeing on the redevelopment of non-residential premises in a residential building.

What the new Ordinance

says

In the capital, the law of April 30, 2014 No. 18 “On improvement in the city of Moscow” is responsible for the preservation of the external architectural appearance. In accordance with it, in February 2022, the Decree “On changing the external architectural design of non-residential buildings, structures, structures in the city of Moscow” was approved, which regulates changes in the external architectural solutions of non-residential buildings, structures and structures.

The Decree spells out how non-residential buildings can be changed outside; what should be the draft of these changes; what sections are necessary in the technical opinion on the admissibility and safety of work to change the external architectural solution of a non-residential object.

According to the new requirements, project documentation must contain data on the design of the facility, information on compliance with safety standards at the facility, and data on the surrounding buildings. Previously, there were no such conditions.

Which buildings are affected by the new Ordinance

The document applies to all non-residential buildings in Moscow, which are located within the outer boundaries of the Garden Ring, as well as on the streets and highways of the capital, which are:

  • administrative and business;
  • teaching and educational;
  • cultural and educational;
  • trade and household;
  • health-improving;
  • sports and recreational;
  • social rehabilitation;
  • teaching and educational.

The exceptions are buildings that are objects of cultural heritage, as well as those that have violations of the requirements for their use, or for work for which a building permit is required – for example, if restoration or extension of premises is planned.

The purpose of the property can be found in the technical inventory documents of the BTI and in the information of the Unified State Register of Real Estate.

In summary, from August 1, it is necessary to coordinate any changes in the facades of non-residential buildings, if these are shopping or office centers, clubs, restaurants, medical clinics, hospitals and clinics, sports facilities, schools, kindergartens, and so on.

It will not be necessary to coordinate the change of facades in industrial, production facilities, warehouses, hotels and apart-hotels.

How to change the facade of a non-residential building

There are clear requirements on how to change the appearance of a non-residential building. Allowed:

  • creation, dismantling of window and door openings in external enclosing structures, as well as changing their shape;
  • conversion of windows into doors;
  • creation and modification of entrance groups in the basement, basement and on the first floors without pouring the foundation and erecting an extension;
  • installation of canopies and canopies within the dimensions of the existing external elements of the building;
  • installation of a new porch, removal or removal of an old one, erection of steps;
  • installation of roller shutters, antennas, outdoor unit of the air conditioning system and so on.

Mandatory part of the project is a section on facades, where there is a photo fixation of the current position, as well as a photomontage of the facade after repair. The project also includes an improvement plan – how visitors will approach the premises, where the urns will be, and so on.

When coordinating changes in facades during photomontage, no advertising or signs are shown in the project. Coloring, signage and advertising are separate types of coordination, and they cannot be done in the same projects.

In a project for a non-residential building, facades will be shown in the same way. Photomontage of planned changes for non-residential buildings is an obligatory part of project documentation. There are no signs or advertising here, as this is agreed separately.

What to do if the facade was changed before August 1, 2022

If the appearance of non-residential buildings was changed before August 1, 2022, then the owners of objects or premises in them need to take care of legalizing the work already done. Specific dates are determined:

  • for non-residential buildings, structures, structures within the outer boundaries of the Garden Ring – until October 1, 2023;
  • for non-residential buildings, structures, structures on the streets and highways of the city of Moscow from the list above – until January 1, 2026.

Before this time, you need to have time to draw up a conclusion on previously completed work to change the appearance of the building in order to avoid fines. And they are very large for legal entities.

Where to apply and what documents to collect for approval of facade changes

In contrast to redevelopment, the façade is approved not by the Moscow Housing Inspection, but by the Moscow Committee for Architecture. The package of documents depends on whether the work is planned or they have already been done.

If the facade of the building is changed , you need:

  • prepare a technical report containing all the necessary sections and information;
  • submit a request to the Moscow Committee for Architecture. If everything is done according to the norms, then they will issue a conclusion on the work performed to change the external architectural solution of a non-residential object. If not, you will have to redo and resubmit the request.

If the change of the facade of the building is still planned , you need:

  • obtain BTI documents, and the technical inventory must be carried out no later than 5 years ago;
  • order a project from the design company, get a technical opinion. We can do it;
  • submit documents for approval to the Moscow Committee for Architecture;
  • receive a decision on project approval;
  • to carry out construction work – 1 year is allotted for this. If these terms are not enough, they can be extended for another year;
  • to receive an opinion on the work performed to change the external architectural solution of a non-residential object. It will be issued after a personal inspection of the object by a specialist of the Moscow Architecture Committee for compliance with the project. If everything is in order, there will be a document on hand, according to which the fact of changing the facade will be approved;
  • to amend the USRN real estate register.

The owner, or the company that coordinates the change of the facade, must also provide a certificate that confirms that the object is not a self-construction, and there are no administrative procedures for the misuse of the land plot in relation to it.

If there is no act, Moskomarkhitektura will request all the information itself, but this may increase the time for consideration of the application by two months, so it is better to prepare the act in advance.

Coordination of non-residential premises with a change in the facade and red lines in the plans of BTI

The owner turned to our company for the development of working documentation in order to make redevelopment inside the premises. After the construction work had already begun, he realized that the facades were in a deplorable state, they also needed to be repaired.

To start facade work, as well as to avoid problems in the future and there are no huge fines, you need a color passport.

To do this, it was decided to completely stop work, call a BTI technician, prepare a project for the color scheme of the facade and coordinate it with the Moscow Architecture Committee.

First, we received intermediate BTI plans, which did not even have stairs, then we developed a draft color solution and received a color passport.

At the time of the release of the technique of the Moscow Committee for Architecture, the plans fully corresponded to the real picture. According to the BTI documents, there were no stairs, and accordingly, at the time the technician left, they had not yet been erected either, so that the BTI plan did not diverge from the actual situation at the facility.

After the color passport has been received, the owner will complete the repair work on the facades, will receive updated BTI plans in red lines. Then the redevelopment and technical conclusion will be agreed in the BTI and plans will be drawn up in black lines.

  • planned or already completed color solutions for individual rooms correspond to the overall color of the building;
  • the binding of window and door openings is preserved;
  • all materials match what is already in the exterior of the building;
  • the project and the technical report comply with the new Decree of Moscow No. 94.

There are many other nuances that only professionals can know about. For example, even the shape and color of the canopies, the structure of the ramp or the appearance of the entrance group play a role. Here is how it looks on the example of canopies for non-residential premises in residential buildings:

The canopy on the left is a bad example and will not pass approval, because it does not correspond to the architectural style of the building and blocks the entrance portal (decorative element), which spoils the appearance of the facade. The visor on the right is a good example. It is authentic, that is, it remained in its original form, as it was originally designed, so it is guaranteed that there will be no questions about it. In order for the visor to be approved the first time, you can make it by analogy with the original version – from the same material, in the same color and dimensions.

The example on the left is a canopy that will fail due to the posts that hit the ground and asphalt. According to paragraph 3.4 of Appendix No. 1 of Moscow Government Decree No. 508, the supports of the visors and the visors themselves must be made within the platforms, stairs, and so on. The requirement is not met in this case. The example on the right is a variant of a good and versatile visor. It will be precisely coordinated, because it is practically invisible, does not have unnecessary piles and structures, does not affect the appearance of the facade in any way, but fulfills its function. A hinged visor made of translucent materials is an example of how you can and should do it. True, sometimes it may not be suitable for buildings with a pronounced architectural style. Most often used in new buildings.

By the same analogy, canopies will be coordinated in non-residential buildings, which relate to the change of the facade.
