Resolution of the Twenty-First Arbitration Court of Appeal dated April 27, 2022 N 21AP-2041 /2021 in case N А83-12433/2020
Demand: On recovery from illegal possession of immovable property.
Decision: The Court of First Instance satisfied the claim. The court of appeal changed the decision of the court of first instance. At the same time, the panel of judges proceeds from the fact that the change in the physical boundaries of the disputed premises (clarification of the area as a result of measurement), the introduction of information about these changes in the cadastral registration documents, registration of ownership of the building, a significant increase in the cost of immovable property as a result of major repairs (improvements) in itself cannot testify to the creation of a new real estate object and does not mean the impossibility of their vindication, since one of the conditions for recovering property from someone else’s illegal possession is the possibility of its individualization and identification, which the judicial panel carries out on based on the evidence presented in the case.

(Elina L. A.)
(“The Main Book”, 2022, N 6) It may be that the formal unification of several parts of the building is accompanied by major repair and construction work. For example, the demolition of partitions and redevelopment of premises. In this case, the costs associated with this are capital investments and also increase the initial cost of the newly formed object. However, the cost of the cost of reconstruction, modernization or other significant improvement of the operating system increases the cost of the operating systems themselves even when they are not combined into one object. That is, you can increase by this cost and individual OS objects in the part in which such work relates to each of these objects.

What are the ways to restore the facade of buildings.
The facade of a building is its face, and therefore it is the first thing people see when they approach it. Therefore, it is not surprising that many homeowners and building managers strive to keep the appearance of their property in good condition. One way to achieve this is to refurbish the façade.
Renovation of a building facade can include a wide range of procedures. They can be as simple as a fresh coat of paint, or as a full-blown renovation. In any case, the goal is always the same: to improve the appearance of the building and make it as attractive as possible.
One of the most common cosmetic repairs to a building’s facade is repainting. This is a relatively simple process that involves cleaning the existing paint, applying a primer, and then applying the new paint. This can be a great way to give a building a fresh, new look without spending too much money.
Another popular option is to repair, replace damaged or missing facade elements. These can be things like damaged brick or stonework, missing roof tiles, or broken window frames. Depending on the extent of the damage, this can be a more complex and costly process, but it can have a significant impact on the building’s appearance.
If the building has suffered weathering or other damage over time, the façade may need to be restored. This involves a deeper process of cleaning, repairing and restoring the various elements of the façade. The purpose of this is to restore the building to its original appearance as well as to ensure its structural strength.
Whatever type of cosmetic repair is required, it is important to see a professional. Attempting to perform this repair without the necessary knowledge and experience can be dangerous and may result in further damage to the building. A professional will be able to assess the damage and recommend the best course of action.
In general, redecorating a building’s façade can have a significant impact on its appearance and help maintain its value. Whether it’s a simple repaint or a more complex restoration, the end result can be a building that looks like new. If you are considering redecorating the facade of your building, be sure to consult with a professional and select the most appropriate redecoration of the facade of your building.

Joint joint
The joint is formed in such a way that a layer of grout can be laid on it, covering 2/3 of the thickness of the thermal panel. This provides additional protection against penetration of precipitation and destruction.

FAQ
What are facade thermal panels?
The products are panels with a multilayer structure. It includes a layer of thermal insulation up to 100 mm thick, an adhesive base and a decorative layer. Thermal insulation is a high-quality insulation made from expanded polystyrene or polyurethane foam
The decorative layer is an imitation of brick, stone, giving the house a unique appearance.
The panels serve as an excellent protection against heat loss, reduce heating costs, prevent moisture and aggressive particles from entering the wall surface, and prevent the appearance of fungus.
How many years can facade panels be used?
Service life is more than 50 years. The high quality of the materials used, the accuracy of shapes, deep seams allow thermal panels to retain an exceptional appearance and high thermal insulation properties for a long time.
What kind of surface is the thermoplate installed on?
Thermal panels can be installed on walls made of any material. It can be concrete, timber, brick, foam concrete. Laying is done directly on the wall surface. If the wall is uneven, a frame base is preliminarily prepared to level it.
Are thermal panels safe?
The materials used for the production of thermal panels are safe for humans. They are installed outside, under the influence of ultraviolet radiation, precipitation, and other negative factors do not emit harmful substances.
All products comply with sanitary and hygienic standards!
Is there a risk that the thermal panel will peel off over time?
This is not possible if the installation is carried out professionally using high quality materials.
The panel is designed with horizontal rails. They reduce the vertical load, contribute to the reliable fastening of each element. For reliable adhesion to the surface, German-made glue is used. After the tiles are glued, all seams are carefully treated with grout.
Is a ready-made thermal panel always installed?
No, installing ready-made thermal tiles on the building surface is only one of the installation methods. They call it “Monolith”. In this case, the buyer receives a thermal panel with a decorative layer already glued.
The second way is “Combi”. In this case, the thermal panel is mounted on the facade, and only after that an artificial stone or clinker tile is installed on it. The method may seem more time-consuming, but it allows you to save both on the material itself and on the mounting fittings – during installation it is not required to install prefabricated corners.
How long does it take to install thermal panels?
Under normal conditions, it takes a week to lay 100 m2 of slab. It is understood that the work is carried out by a team of 4 qualified specialists.
It should be noted that the panels can be laid at any time of the year in any weather.
Can the panels be installed by ourselves?
In principle, there is nothing difficult in laying the panels, especially since this does not require a foundation.
However, in order to avoid problems with operation, it is better to involve specialists for this work.
